WHEREAS LICENSOR is the owner of the plant varieties which are covered by this licence agreement and enjoy Community protection, cf. Council Regulation (EC) No. 2100/94 of 27 July 1994 on Community plant variety rights; and the UK Plant Varieties and Seeds Act 1964 (as amended by the Plant Breeders' Rights Amendment Regulations 1980 (*). WHEREAS LICENSEE wishes to exploit the plant varieties covered by this licence agreement commercially; NOW, THEREFORE, the parties have made the following licence agreement :
If the grower has a Licence Agreement with Appendix A that allows own propagation and sale of finished products, indicating that propagation is permitted by means of cuttings, this permission only applies to propagation by cuttings, not to any other method. The grower in question can thus only propagate for his own finished product sale and therefore only sell finished products and is not allowed to sell propagating material, such as cuttings. Furthermore, the plants may not be passed on for onward cultivation, e.g. by means of a transfer of pre-finished plants. In such cases we are to be informed and the contract grower in question must have a separate Licence Agreement permitting him to cultivate the plants. Requests from customers for the purchase of cuttings are to be forwarded to Poulsen Roser A/S.
